Bangladesh Labor Law Summary
 
Working Hours:
Daily Work Hours (Labor Code 2006-100): General 8 + Overtime 2
Weekly Work Hours (Labor Code 2006-102):

General 48 + Overtime 12

On average 56 hours per week in a year
 

Daily Rest:

Daily Rest (Labor Code 2006-101): After six hours work 1 hour break or two half an hour breaks after 5 hours and 8.5 hours of work.
 
Weekly Rest (Labor Code 2006-103):
Shop, commercial or Industrial establishment: One and half days/week
Factories and other establishments: One day/Week
Road transportation establishment:

One day for 24 hours consecutive work.

As soon as circumstances permit, compensatory holidays of equal number to be provided (Labor Code 2006-104)
If employees work on weekend, as soon as circumstances permit, compensatory holidays of equal number to be provided (Labor Code 2006-104)
 
Minimum Wage, Overtime Wage and Overtime Allowance:
Minimum wage: Pls see minimum wage gazette October 22, 2006
Overtime Hours (Labor Code 2006-108): More than 8 hours of work/day More than 48 hours of work/week
Overtime allowance (Code 2006-108): (Basic Wage / 208) X 2 X OT hours.
 

Leave and Benefits:

Casual Leave (Code 2006-115)
10 days/Year (No carry forward)
Sick Leave (Code 2006-115)  

14 days/Year (No carry forward)

Annual Leave (Code 2006-117)

1 Day earned for 18 days work.
Can be availed during the subsequent period of twelve months. Can be carried forward to the next year but cease in 40 days for adult workers

Festival Holidays (Code 118)
Days/ Year. If work on festival holiday the worker is entitled for two days leave with full wages and another alternative holiday.
Maternity Leave (Code 2006-46) 16 (8+8) weeks with full pay
Group Insurance (Code 2006-99) Every factory where more than 200 workers were employed, to be introduced mandatoryGroup Insurance scheme.
Workers Participation in Companies Profi (Code 2006-232-252) If 100 or more employees employed, Paid up Capital is at least take one crore, Fixed Asset is at least taka two crore of a company then this section applies. (Pls see the sections for details)
   

Payment of wages:

Wages Periods (Code 2006-122): Shall not exceed one month.
Time of payment of wages (Code 2006-123): Before the expiry of the seventh working day of the wages period in respect of which wages are payable.
Deduction for absenteeism (Code 2006-126):

Deduction to be made proportionately from the wage for the absent period.
This section does not support the following:
One day absent for three days late
Weekend/Paid Holidays considered as absent day for consecutive absenteeism.
Adjusting OT hours with absent days
Etc.

 

   
Employee Documentation:
Appointment Letter and Identity Card (Code 2006-5)

Appointment letter and ID card with
photograph must be provided by the
employer.

Service Book (Code 2006-6)

Employer shall maintain service book for every worker employed by him.

   
Termination of Contract
By employee (Code 2006-27)

60 days notice required in writing

By employer (Code 2006-26)

120 days notice required for monthly
rate workers in writing
60 days for other workers in writing

   
Employee welfare committee
Labor Code 2006-205 Applicable for the facility where 50 or more employees are employed.
   

Health and Safety:

Exits (Factories rules, 1979, Chapter-4, Section-51) Minimum two exits required
Staircase (Code 2006-62, Factory Rule section-51) At least two stair cases of 45” in width
Exit, Alarm, fire Drill etc (Labor Code 2006-62)

Exits are to be marked. Need fire alarm, Need free path way. Evacuation plot plan to be posted. Fire drill once a year.

Fire fighting team (Factories rules, Section-51) At least 25% workers are to be trained.
First Aid Kit (Labor Code 2006-89) One first aid box for every 150 workers.
Pulley guard/Eye guard/ Needle guard: (Code 2006-69)

Every dangerous part of any machinery(moving or in use) shall be securely fenced by the safeguards

Cleanliness, lighting etc (Code 2006-51,52,53,56,57)

Cleanliness to be ensured. Proper ventilation and comfortable temperature needed. Should be free from dust and fume. Should not be overcrowded. Sufficient and suitable lighting required.

Drinking Water (Labor Code 2006-58) Pure drinking water to be provided
Canteen (Labor Code 2006-92)

Canteen needed if more than 100 workers are employed

Dining (Labor Code 2006-93) If more than 50 workers employed a rest room and lunch room required
Child Care Room (Code 2006-94) If more than 40 female workers employed then child care room needed
Waste Disposal (Labor Code 2006-54)
